By accepting these Terms of Service, you agree to be bound by this arbitration clause and class action waiver. Please read it carefully.

Welcome to Luxus BP ! These Terms of Service (this “Agreement”), and all of the policies included on our sites (both mobile and web), plus those designed to authorize certain relationships (such as the Vehicle Rental Agreement), collectively create the terms and conditions on which Luxus BP offers you access to and use of its services, which include the use of the Luxus BP site (both mobile and web), products and marketplace (collectively, the “Services”). If you decide to access and use the Services, you agree to be bound by this Agreement. If you do not wish to be bound by this Agreement, do not access or use the Services.

You consent to entering these terms electronically, and to the storage of records related to these terms in electronic form.

This Agreement includes Luxus BP ’s Privacy Policy, also included in this Agreement are our other policies, plus any other agreements designed to authorize certain relationships, such as the Vehicle Rental Agreement, all of which are also incorporated by this reference. Please review all of the terms and conditions carefully. BY USING OUR SERVICES, YOU ARE ACCEPTING AND CONSENTING TO THESE TERMS AND CONDITIONS, AS UPDATED AND AMENDED FROM TIME TO TIME. IF, FOR ANY REASON, YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, PLEASE STOP USING THE SERVICES IMMEDIATELY.

1. Acceptance of Terms
By using Luxus BP Car Rental’s services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.

2. Eligibility
You must be at least 21 years old to rent a car from Luxus BP Car Rental. Additionally, you must possess a valid driver’s license and provide accurate and complete information during the reservation process.

3. Reservation and Rental
3.1 Reservation: Reservations can be made online, in person, or over the phone. All reservations are subject to availability.
3.2 Rental Period: The rental period begins and ends as specified in your reservation. Late returns may incur additional charges.
3.3 Vehicle Availability: Luxus BP Car Rental reserves the right to substitute a similar
vehicle in the event the reserved vehicle is unavailable.

4. Reservations and Transactions
4.1 Acceptance: All reservations and transactions made through the Site are subject to Luxus BP Car Rental’s acceptance, which is at our sole discretion.
4.2 Refusal or Cancellation: Luxus BP Car Rental may refuse to accept or may cancel any reservation or transaction, whether confirmed or not, for any reason, at our sole discretion, and without liability to you or any third party.
4.3 Location of Rental Contracts: Rental contracts are exclusively entered into at branch locations of Luxus BP Car Rental and its affiliates, their respective franchisees, and are not entered into through this Site.
4.4 Early Returns: There is not refund for early returns.

5. Rental Requirements
5.1 Driver’s License: Renters and additional drivers must present a valid driver’s license at the time of rental.
5.2 Payment: Payment must be made with a valid credit card. Debit cards and cash may be accepted with additional conditions.
5.3 Security Deposit: A security deposit may be required at the time of rental and will be refunded upon the return of the vehicle in the same condition.

6. Vehicle Use and Restrictions
6.1 Authorized Drivers: Only individuals listed on the rental agreement are authorized to drive the rented vehicle.
6.2 Prohibited Uses: The vehicle must not be used for illegal activities, racing, off-road driving, towing, or carrying hazardous materials.

7. Liability: Renters are responsible for all damage to the rented vehicle up to the full value of the vehicle.

8. Cancellation and Modification
8.1 Cancellation: Reservations can be canceled with advance notice. Cancellation fees may apply.
8.2 Modification: Changes to reservations are subject to availability and may incur additional charges.
8.3 If the reservation is canceled 24h before the pickup time a 50% charge of late cancelation fees will be applied.

9. Indemnity
You agree to indemnify and hold Luxus BP and its related companies and each of their
respective directors, officers, employees, and agents harmless from and against any
third-party claim or cause of action, including reasonable attorneys’ fees and costs,
arising, directly or indirectly, in whole or in part, out of your access or use of the Site or
your violation of any law or the rights of any person.

10. General
10.1 Severability: If any provision of these Terms of Use is held to be invalid or unenforceable, that provision must be construed consistent with applicable law, and the remaining provisions must be enforced.
10.2 Headings: Headings are for reference purposes only and in no way define, limit, construe or describe the scope of such section.
10.3 Waiver: Our failure to enforce any provision of these Terms of Use shall not constitute a waiver of that or any other provision.
10.4 Entire Agreement: These Terms of Use set forth the entire agreement between you and Luxus BP in connection with your use of the Site.

11. Responsibility for Legal Action Customers are responsible for any legal action against them to recover pending balances.

12. Limitation of Liability
In no event shall Luxus BP, its related companies, and each such company’s directors, officers, employees and agents be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of or in connection with your access, use or inability to use the Site, any information provided by the Site or any transaction entered into through the Site. Some jurisdictions do not allow the exclusion of certain damages, so the above may not apply to you. If any authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest extent permitted by applicable law.

The foregoing limitation of liability is not applicable to residents of New Jersey. With respect to residents of New Jersey, Luxus BP, its related companies, and each such company’s directors, officers, employees, and agent are not liable for any damages unless such damages are the result of our negligent or reckless acts or omissions; and We are not, in any case liable for indirect, incidental, special, consequential or punitive damages.

13. No Warranty
While We use our reasonable efforts to maintain the accuracy and reliability of the Site, We do not warrant or represent that it will always function or be error-free. We assume no responsibility or liability for errors or omissions on the Site or for problems with its operation. Your access and use of the Site are at your own risk. Without limiting the foregoing, THE SITE, ITS CONTENT AND ANY PRODUCT OR SERVICE OFFERED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. Some jurisdictions do not allow the exclusion of certain warranties, so the above may not apply to you.

14. Site Modifications
We reserve the right, in our sole discretion, to modify, suspend or discontinue any part of the Site at any time, without notice or liability to you or any third party. We also reserve the right, in our sole discretion, to impose limits on certain features and services.

15. Termination of Rental
Luxus BP Car Rental reserves the right to terminate a rental if the renter violates these Terms or misuses the vehicle.

16. Governing Law
These Terms are governed by the laws of the state of New Jersey.
